Terms of Use for Trakkit

These Terms of Use ("Terms") govern your use of the Trakkit mobile application ("the App," "Trakkit"), operated by Mesut Erce Ekmekçi, a sole proprietor ("the Operator," "we," "us," or "our").
By downloading, accessing, or using Trakkit, you agree to be bound by these Terms and by Apple's standard End User License Agreement (the "Apple Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If you do not agree, do not use the App.

1. The Service
Trakkit is a training application that generates speed and explosiveness training plans, tracks your performance and progress, and offers optional features including a reaction-time trainer and an AI-assisted video technique analysis ("Form Lab"). Trakkit provides general athletic training information and tools; it is not a substitute for professional coaching, medical advice, or supervised training.
2. Eligibility
You may use Trakkit only if you can form a binding contract with the Operator, or if a parent or legal guardian agrees to these Terms on your behalf. Certain features (such as Form Lab) are restricted by age as described in the App and in our Privacy Policy. If you are a minor, you should use Trakkit only with the involvement and consent of a parent, guardian, or coach.
3. Health, Safety, and No Medical Advice
Important — read carefully:
- Trakkit provides general fitness and training information for informational and educational purposes only. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for professional medical or coaching guidance.
- Physical training carries inherent risks, including injury. Before starting any training program, you should consult a qualified physician or healthcare professional, especially if you have any medical condition, injury, or concern.
- The AI Form Lab feature offers automated, general technique observations based on a short video. It is not a biomechanical assessment, not a medical or diagnostic tool, and may be incomplete or inaccurate. Do not rely on it as professional coaching or medical guidance. Use your own judgment and consult a qualified coach or professional.
- You are solely responsible for exercising safely, using appropriate technique, and stopping if you feel pain or discomfort. By using Trakkit, you assume all risks associated with your training.
4. Subscriptions, Billing, and Free Trials
Trakkit offers auto-renewable subscriptions that unlock the App's features:
- Annual subscription: US$39.99 per year, which may include a 3-day free trial for eligible new users.
- Weekly subscription: US$7.99 per week.
Prices may vary by region and are shown in your local currency on the purchase screen. The exact price, billing period, and any free-trial terms are displayed in the App before you confirm a purchase.
Billing terms:
- Payment is charged to your Apple ID account upon confirmation of purchase.
- Auto-renewal: Your subscription automatically renews at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the price of the selected plan.
- Free trial: If your subscription includes a free trial, any unused portion of the trial is forfeited when you purchase a subscription, where applicable. If you do not cancel before the trial ends, the subscription will begin and you will be charged.
- Managing and canceling: You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID account settings (Settings → your name → Subscriptions). Deleting the App does not cancel your subscription.
- Refunds: Purchases are processed by Apple. Refund requests are handled by Apple in accordance with their policies; we generally cannot issue refunds directly.
5. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use Trakkit on Apple devices you own or control, for your personal, non-commercial use. You may not copy, modify, reverse-engineer, distribute, sell, or create derivative works from the App except as permitted by law.
6. Acceptable Use
You agree not to: use the App for any unlawful purpose; attempt to gain unauthorized access to the App or its related systems; interfere with or disrupt the App; misuse the Form Lab feature by submitting content that is unlawful, that infringes others' rights, or that depicts a person who has not consented; or use the App in any way that could harm the Operator or other users.
7. User Content
You retain ownership of content you create or submit (such as a video for Form Lab). By submitting content for processing, you grant us and our service providers the limited right to process that content solely to provide the requested feature. You are responsible for ensuring you have the right to submit any content, and that any person depicted has consented.
8. Intellectual Property
The App, including its design, software, training content, and branding ("Trakkit"), is owned by the Operator and protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property except the limited license described above.
9. Third-Party Services
Trakkit relies on third-party services (including Apple, RevenueCat, fal.ai, Google, and TelemetryDeck) as described in our Privacy Policy. Your use of features that rely on these services may also be subject to those providers' terms. We are not responsible for third-party services.
10. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY TRAINING RESULTS, PROJECTIONS, OR AI ASSESSMENTS WILL BE ACCURATE OR ACHIEVED. PROJECTED IMPROVEMENTS SHOWN IN THE APP ARE ILLUSTRATIVE ESTIMATES, NOT GUARANTEES.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR PERSONAL INJURY, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE APP. TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, IT IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR US$50, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless the Operator from any claims, damages, or expenses arising from your misuse of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time and delete your data as described in our Privacy Policy. Sections that by their nature should survive termination (including disclaimers, limitation of liability, and intellectual property) will survive.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide notice in the App. Your continued use of the App after changes take effect constitutes acceptance.
15. Governing Law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence provide otherwise. Nothing in these Terms limits any non-waivable statutory consumer rights you may have.
16. Apple-Specific Terms
These Terms are between you and the Operator, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
